Section 63 – Information to foreign, supranational and intergovernmental bodies
(1) Requests for information from bodies of another State as well as from supranational and intergovernmental bodies shall be executed by the register authority in accordance with the relevant international treaties, insofar as the legislative bodies have participated in them pursuant to article 59 (2) sentence 1 of the Constitution.
(2) Requests for information from another Member State of the European Union shall be executed by the register authority. Unless an international treaty within the meaning of (1) exists, the information may be provided to the requesting Member State for the same purposes and to the same extent as in relation to comparable German bodies. The receiving body shall be informed that it may use the information only for the purpose for which it was provided. The information shall not be provided if it is in conflict with the Charter of Fundamental Rights of the European Union.
(3) If another Member State of the European Union requests information from the register for non-criminal purposes, the nature or scope of which is not provided for in this Act, the register authority shall carry out the request to the extent that it is required by a legal act of the European Union, unless a special technical assessment is necessary to restrict the information. If such an assessment is necessary, the authority responsible for international administrative assistance shall obtain information from the register. (2) sentences 2 and 3 and Section 8e of the Administrative Procedure Act shall apply mutatis mutandis.
(4) The responsibility for the admissibility of the transmission lies with the transmitting agency.
