Section 37 – Non-prosecution in case of serious consequences for the corporation

(1) Section 153b(1) of the Code of Criminal Procedure shall apply subject to the proviso that the prosecuting authority may, with the consent of the court competent for the opening of the main proceedings, refrain from prosecuting the corporation if the corporation has suffered consequences as a result of the corporate crime which are so serious that the imposition of a sanction would manifestly be inappropriate.

(2) If the action has already been filed, the court may, with the consent of the prosecuting authority and the corporation, discontinue the proceedings until the main proceedings have begun.
